General Terms and Conditions (GTC) of MVP Sports AG

1. Applicability of the GTC

These general terms and conditions (GTC) apply to all merchandise orders placed through the website/online shop of MVP Sports AG, Riedstrasse 5, 6330 Cham, Switzerland. The version of the GTC published on the website/online shop at the time of the order is authoritative. Changes to the GTC are reserved at any time. In addition, – insofar as the GTC do not contain any regulations – the relevant provisions of the Swiss Code of Obligations (OR) apply.

2. Contractual Territory

Currently, the MVP Sports AG online shop only provides for goods deliveries within Switzerland and the Principality of Liechtenstein. Orders from other countries can be processed upon request.

3. Prices

The offer is valid while stocks last. All prices are stated in Swiss Francs (CHF) and include statutory VAT. Any increase or decrease in VAT by the tax authorities will be adjusted accordingly.

4. Conclusion of Contract and Withdrawal

All information on goods and prices on the website/online shop of MVP Sports AG is subject to change and non-binding. By placing an order via the website/online shop, the customer submits a binding offer. MVP Sports AG confirms acceptance by e-mail (order confirmation) to the customer. A contract is only concluded with this express acceptance, and the customer receives the right to delivery of the goods. If the goods ordered by the customer are not available in the desired quantity or at the stated price, the customer will be informed, and an alternative product can be offered. The contract is valid as soon as the customer accepts the changed order.

Orders and agreements by telephone are only valid if confirmed in writing or by e-mail.

In the event of typing, printing, and calculation errors on the website/online shop, MVP Sports AG is entitled to withdraw free of charge.

5. Payment

Payment for the ordered goods is made using the payment methods available in the online shop. For prepayment: If payment is not made within 5 days, the order will be canceled.

6. Delivery / Shipping

Delivery costs are shown in the shopping cart and/or at checkout. Goods are delivered during the opening hours indicated on the website/online shop, subject to availability. Benefit and risk pass to the customer upon handover of the goods to the carrier. Express shipments are possible upon request. Goods are shipped after receipt of payment by courier service or post. Claims for damages due to delayed delivery are excluded.

7. Retention of Title

Until full settlement of all claims against the customer, the delivered goods remain the property of MVP Sports AG.

8. Right of Withdrawal / Return

Exchanges and complaints can only be considered within 8 days of receipt of the goods and must be reported in writing. The complaint or return must be registered via the customer account or by e-mail. Items that have been custom-made are excluded from exchange and return. Items that are declared or used as underwear are excluded from exchange and return.

The right of withdrawal can only be effectively exercised if the goods are returned unused, undamaged, complete, unopened, and in immaculate original packaging. The costs and the risk for the return shipment are borne by the customer. Returns should be sent to:

Shipping costs already incurred will not be refunded. Incorrectly ordered textiles or custom-made products are excluded from exchange or refund. Customized products, such as refined products, are excluded from exchange.

9. Warranty

MVP Sports AG guarantees the delivery of flawless goods. Should there nevertheless be defects in the delivered goods, the customer is obliged to report these in writing within 8 days of delivery. After returning the defective goods, the customer will receive a replacement delivery or, if a replacement delivery is not possible, a refund of the purchase price. Further claims, in particular for damages, are excluded to the extent permitted by law.

Changes in the external appearance of the products by the manufacturer do not constitute a defect. Illustrations and size charts in the online shop are for illustration purposes only and are non-binding.

10. Law and Jurisdiction

The exclusive place of jurisdiction for all disputes in connection with the contractual relationship is CH-6330 Cham, Switzerland. Swiss law applies.
