General Terms and Conditions (GTC) of MVP Sports AG

1. Validity of the General Terms and Conditions
These General Terms and Conditions (GTC) apply to all orders placed via the website/online shop of MVP Sports AG, Riedstrasse 5, 6330 Cham, Switzerland. The version of the GTC published on the website/online shop at the time of the order shall prevail. Changes to the GTC are reserved at any time. In addition, unless otherwise provided in the GTC, the relevant provisions of the Swiss Code of Obligations (CO) shall apply.
2. Contract area
In the online shop of MVP Sports AG currently only ships goods to Switzerland and the Principality of Liechtenstein. Orders from other countries can be processed upon request.
3. Prices
This offer is valid while supplies last. All prices are quoted in Swiss francs (CHF) and include statutory VAT. Any increase or decrease in VAT by the tax authorities will be adjusted accordingly.
4. Conclusion of contract and withdrawal
All information about goods and prices on the website/online shop of MVP Sports AG are subject to change and non-binding. By placing an order via the website/online shop, the customer submits a binding offer. MVP Sports AG confirms acceptance to the customer via email (order confirmation). Only with this explicit acceptance is a contract concluded, and the customer is entitled to delivery of the goods. If the goods ordered by the customer are not available in the desired quantity or at the stated price, the customer will be informed, and an alternative product may be offered. The contract is valid as soon as the customer accepts the amended order.
Orders and agreements made by telephone are only valid if they are confirmed in writing or by email.
In case of typographical, printing or calculation errors on the website/online shop, MVP Sports AG is entitled to withdraw free of charge.
5. Payment
Payment for the ordered goods is made using the payment methods available in the online shop. For advance payment, the following applies: If payment is not received within 5 days, the order will be canceled.
6. Delivery / Shipping
Delivery costs are displayed in the shopping cart and/or during checkout. Goods are delivered during the opening hours stated on the website/online shop, subject to availability. Risk and benefit are transferred to the customer upon handover of the goods to the carrier. Express shipments are available upon request. Goods will be dispatched by courier or post after receipt of payment. Claims for damages due to delayed delivery are excluded.
7. Retention of title
Until all claims against the customer have been settled in full, the delivered goods remain the property of MVP Sports AG.
8. Right of withdrawal / return
Exchanges and complaints can only be considered within 8 days of receipt of the goods and must be submitted in writing. Complaints or returns can be submitted via the customer account or by email. Custom-made items are excluded from exchange and return. Items declared or used as underwear are excluded from the Exchange and return are excluded.
The right of withdrawal can only be legally exercised if the goods are returned unused, undamaged, complete, unopened, and in perfect original packaging. The customer bears the costs and risk of return shipping. Returns should be made to:

Shipping costs already incurred will not be refunded. Incorrectly ordered textiles or custom-made products are excluded from exchange or refund. Customized products, such as finished products, are excluded from exchange.
9. Warranty
MVP Sports AG guarantees the delivery of flawless goods. Should any defects in the delivered goods nevertheless exist, the customer is obligated to report them in writing within 8 days of delivery. Upon return of the defective goods, the customer will receive a replacement delivery or, if replacement delivery is not possible, a refund of the purchase price. Further claims, in particular for damages, are excluded to the extent permitted by law.
Changes in the external appearance of the products by the manufacturer do not constitute a defect. Images and size charts in the online shop are for illustrative purposes only and are non-binding.
10. Law and Jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contractual relationship is CH-6330 Cham, Switzerland. Swiss law applies.
